Will Judge Alito Threaten Employee Rights?

In a report sent to the Senate Judiciary Committee, the National Employment Lawyers Association (NELA) expressed their strong opposition to President Bush's nomination of Judge Samuel Alito to the U.S. Supreme Court. Barry
Roseman, Chair of NELA’s Judicial Oversight Committee, said, “our extensive review of Judge Alito’s employment rulings raises serious concerns about whether he will place the interest of employers over the rights of employees.” Mr. Roseman went on to explain NELA's concern over the fact that Judge Alito's "apparent belief that the law has gone too far in the direction of protecting workplace fairness given that he is being nominated to replace Justice Sandra Day O’Connor, who has not only been the critical vote and voice of reason in significant discrimination and harassment rulings during the past 20 years, but who also has demonstrated a thorough understanding of the stereotyping that forms the basis for much workplace discrimination."
