Are No Smoking Policies Legal?

A Massachusetts man recently sued his former employer for firing him after a urine test indicated he had violated the company's no smoking policy. The Boston Globe article, which appears on Boston.com, says The Scotts Co. last year announced they would no longer hire tobacco users in order to drive down medical costs. This makes sense, but does a no smoking policy violate employees' privacy rights? It makes you wonder how much control your boss can have over what you do outside of work.
